Michigan Tribunal Overstepped in Tax Break Case, Court Rules

The Michigan Tax Tribunal exceeded its authority when it ruled that two taxpayers didn't owe back taxes because of an assessor's error, a state appeals court ruled. The tribunal wasn't authorized to “completely disregard petitioners' positions and address and rule on an issue that was not presented by anyone and that exceeded the MTT's jurisdiction and powers,” the Michigan Court of Appeals ruled Thursday in an unpublished, unsigned opinion.

He said the effort of gathering tens of thousands signatures of Wyoming voters proves that if the Legislature fails to act on property taxes, Cowboy State residents can do it themselves.
